In Canada the leading cases on ethical or regulatory obligations of professionals will depend on the profession and the specific obligation dictated by the professional rules, but the core authorities emphasize professional competence, loyalty, civility, and deference to regulatory bodies, for example:

  • A solicitor must bring reasonable care, skill, and knowledge to the retainer; the duty includes reasonable knowledge of relevant law, see Central Trust Co. v. Rafuse, 2 S.C.R. 147. "A lawyer is not expected to know every point of law, but must know enough to recognize when legal research or advice is required."
  • In R. v. Neil, 2002 SCC 70, [2002] 3 S.C.R. 631, the Court reframed legal ethics around a positive duty of loyalty rather than merely the avoidance of conflicts.
  • In Hopp v. Lepp, 1980 CanLII 14 (SCC), [1980] 2 SCR 192, the Court held that a physician has a duty to disclose the material risks of a proposed treatment so the patient can make an informed decision.
  • Also, Reibl v. Hughes, 1980 CanLII 23 (SCC), [1980] 2 SCR 880, states that that failure to disclose material risks in a procedure is negligence rather than battery where the patient consented to the nature of the procedure, and that causation is assessed objectively by asking what a reasonable person in the patient’s position would have done.
